The Supreme Court said it could not stay the Election Commission’s order “at this stage”. The Thackeray camp can use legal challenges if any action is not based on the Election Commission’s orders.

The name and symbol of the Shiv Sena will remain with Maharashtra Chief Minister Eknath Shinde’s Shiv Sena and Uddhav Thackeray’s symbol “Mashal” or burning torch will remain for the time being, the Supreme Court said today. NDTV reported that the dispute has been going on since the party split last year.

The Supreme Court said it could not stay the Election Commission’s order “at this stage”. The Thackeray camp can use legal challenges if any action is not based on the Election Commission’s orders.

The court has agreed to hear the plea of Tim Thackeray challenging the Election Commission’s order to give Shiv Sena’s name and “bow and arrow” symbol to the Shinde faction.

Thackeray had demanded that the status quo be maintained till the outcome of the case. Kapil Sibal, who represented him in the court, told a bench headed by Chief Justice DY Chandrachud that he wanted protection.

“We need protection. We do not want our properties and bank accounts to be seized,” said Mr. Sibal said that the Shiv Sena parliamentary office was taken over by the Shinde group yesterday.

Tim Shinde has argued that the matter has already been heard and dismissed by the High Court and allowed the Election Commission to go ahead and take a decision.

He asked that the Uddhav Thackeray group should come directly to the Supreme Court, why the court should interfere.
